Terms of Service — Animon AI

Please read these Terms of Service ("Terms") carefully before using Animon AI ("the Service"). By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Acceptance of Terms

By creating an account or using any feature of Animon AI, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of Service

Animon AI provides AI-powered tools for generating anime-style videos and images from text prompts. Features and capabilities may change over time. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. User Accounts

You must sign in via Google OAuth to access paid or credit-based features. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. Please notify us immediately at [email protected] if you suspect unauthorized access.

4. Subscriptions and Payments

Animon AI offers both free and paid plans. By purchasing a subscription or credits, you agree to the following:

• Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your plan). One-time credit purchases are charged immediately.
• Payment Processing: All payments are processed by our third-party payment provider. By completing a purchase, you authorize us to charge the applicable fees to your designated payment method.
• Price Changes: We may change subscription prices with at least 14 days' prior notice. Continued use after the price change takes effect constitutes acceptance of the new pricing.
• Taxes: Prices shown may be exclusive of applicable taxes. You are responsible for any sales, use, VAT, or similar taxes applicable to your purchase.
• Failed Payments: If a payment fails, we may suspend or downgrade your account until the outstanding balance is resolved.

5. Credits

Credits are a virtual currency used to generate videos and images on Animon AI. Credits have no cash value and cannot be transferred, sold, or exchanged for real currency. Unused credits from one-time purchases do not expire; subscription-period credits expire at the end of each billing cycle unless otherwise stated on the pricing page.

6. Refund Policy

All purchases are generally non-refundable. We may, at our sole discretion, issue a refund or credit in the following circumstances:

• A technical error on our platform caused a generation failure and credits were deducted.
• You were charged in error (e.g., duplicate transaction).

Refund requests must be submitted within 7 days of the charge to [email protected] with your order details. We do not provide refunds for partially used subscription periods.

7. Cancellation

You may cancel your subscription at any time from your account settings or by contacting [email protected]. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date. No prorated refunds are issued for unused days in the current period.

8. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, hateful, sexually explicit involving minors, or violates any applicable law.
• Infringe upon the intellectual property rights of any third party.
• Attempt to reverse-engineer, scrape, or disrupt the Service.
• Use automated tools to generate content at scale beyond normal personal use without prior written consent.

Violation of this section may result in immediate account termination without refund.

9. Intellectual Property

All platform code, design, branding, and underlying AI models are the property of Animon AI. Content you generate using the Service is owned by you, subject to your compliance with these Terms and our acceptable use policy. We retain a non-exclusive license to display generated content for promotional purposes unless you opt out.

10. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated outputs will meet your expectations. AI-generated content may be imperfect or unexpected.

11. Limitation of Liability

To the maximum extent permitted by law, Animon AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or other conduct harmful to the Service or its users. Upon termination, your right to use the Service ceases immediately and unused credits are forfeited.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the website. Continued use of the Service after the updated Terms take effect constitutes your acceptance.

14. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.
